Estates & trusts

Selling a probate, trust, or inherited home.

Selling a loved one's home is emotional and full of paperwork. Troy works with executors, trustees, and heirs — and their attorneys — to prepare the property, follow the required steps, and keep everyone informed through closing.

May be a good fit if…

  • You are an executor, administrator, or trustee selling a home.
  • You inherited a property and are deciding whether to sell, rent, or keep it.
  • The home needs clean-out, repairs, or vendor coordination before it sells.

What to know

Probate vs. trust

Homes held in a living trust are usually sold by the trustee without court involvement. Homes in probate follow court rules.

Court confirmation or IAEA

With full authority under California's Independent Administration of Estates Act, a sale may proceed after a Notice of Proposed Action. Otherwise the court confirms the sale, and others may overbid at the hearing.

Taxes and Prop 19

Inherited property can have a stepped-up tax basis, and Prop 19 changed parent-to-child property tax transfers. Ask a tax professional how they apply.

Questions worth asking

  • Is the property in probate, in a trust, or neither?
  • Does the personal representative have full IAEA authority?
  • Is it better to sell as-is or make repairs first?

Frequently asked questions

Can a house be sold during probate in California?

Yes. Depending on the authority the court grants, the sale may need court confirmation or may proceed under the Independent Administration of Estates Act. The estate's attorney can confirm which applies.

What is court confirmation?

A hearing where the court approves the sale. Other buyers may attend and overbid, so the final buyer and price can change.

Does Troy give legal or tax advice?

No. Troy handles the real estate side and works alongside the estate's attorney and tax professionals.
